Hostalric Town Council accepts no liability arising from the incorrect, inappropriate or unlawful use of the information appearing on its website or online presence in the various social networks. Within the limits established by law, Hostalric Town Council accepts no liability arising from the lack of veracity, integrity, updating and accuracy of the data or information contained in its online media.

The contents and information on the website and social media pages of Hostalric Town Council are prepared by professionals duly qualified to exercise their profession. However, the contents and information do not bind the aforementioned, nor do they constitute opinions, advice or legal counsel of any kind, as it is merely a service offered for informational and informative purposes.

The website or social media pages of Hostalric Town Council may contain links to other, third-party websites not owned or controlled by us. We are therefore not responsible for the content of such third-party websites. The text, images, sounds, animations, software and other content included on this website are the exclusive property of Hostalric Town Council or its licensors. Any act of transmission, distribution, assignment, reproduction, storage or total or partial public communication must have the express consent of Hostalric Town Council.

Similarly, Hostalric Town Council reserves the right to withdraw access to the website at any time, without prior notice, from any user who contravenes the provisions of this legal notice.

SOCIAL NETWORKS

The user must have a profile on the aforementioned social networks to be able to interact with Hostalric Town Council, and must accept the relationship with our social media pages. Hostalric Town Council will have access to the user’s profile in accordance with the parameters stipulated by the social network itself and will be able to interact with the user by sending messages, publications and invitations to participate in contests and draws. If the user does not want Hostalric Town Council to be able to access their profile or interact with it, they will need to unlink the profile by unfollowing or removing Hostalric Town Council as a friend, follower or user.

The actions carried out by Hostalric Town Council may be informative and/or aimed at advertising its services or products, considering that the social network is an advertising medium, under the responsibility of Hostalric Town Council in terms of the publications and communications made via these online media.

The user’s participation in contests, promotions or draws implies that the user accepts the legal bases of the contest, promotion or draw which will be published on the relevant social network at the appropriate time, and with their participation implies that the user has accepted them.

Users are reminded that the publications they make on social networks are their responsibility and they must respect the legislation and the rights of any third party that may be affected, particularly with respect to intellectual property rights, data protection and the image rights of third parties, as well as the rules of the social networks themselves, as listed below:

PROTECTION OF PERSONAL DATA

In accordance with personal data protection regulations, you hereby authorise that the personal data you provide in the online media will be processed and incorporated into files owned by Hostalric Town Council, with CIF P1708900D and registered address at C/ Raval, 45, 17450 Hostalric (Girona):

– The data provided in the contact forms will be incorporated into the Contacts file owned by Hostalric Town Council, so that we can manage and respond to your request or query. These data will be held until your request or query has been resolved and will not be transferred to third parties.

– Newsletter registration form: Your data will be incorporated into the Contacts file so that we can inform you of our activities, promotions and agenda. These data will be held for as long as your consent remains in place and will not be transferred to third parties.

– If processed on our social networks, as detailed above, they will be incorporated into the Social Networks and Marketing file managed by Hostalric Town Council, to allow us to manage the information and data obtained from the interaction of social network users with Hostalric Town Council’s profiles and pages. These data will be kept for as long as the legitimate interest for their processing is maintained.

In any case, you may indicate the revocation of the consent given, if this was the basis that legitimised the processing of the data, or exercise the following rights:

– Access: The data subject has the right to know whether the data controller processes data concerning them and, if so, has the right to access this data and to obtain information about the processing carried out.

– Rectification: This is linked to the inaccuracy or incompleteness of the data. The data subject has the right to rectify inaccurate personal data concerning them and to have incomplete personal data completed.

– Erasure: The data subject has the right to request the erasure of their personal data (“right to be forgotten”) when these are no longer necessary for the purpose for which they were collected, the consent on which the processing was based is revoked, the data subject objects to the processing, the data have been unlawfully processed, they must be erased to comply with a legal obligation or have been obtained in relation to the offer of information society services directed at minors.

– Restriction of processing: The data subject has the right to mark their personal data stored, in order to limit their future processing. The restriction of processing means that, at the request of the data subject, their indicated personal data will cease to be processed.

– Objection: The data subject has the right to object to the processing of their data when these are based on certain specific grounds and a reason related to their particular situation is invoked.

– Data portability. The data subject has the right to receive their personal data provided to the data controller in a structured, commonly used and machine-readable format, if based on consent or a contract, or if the processing is carried out by automated means.

– Not to be subject to automated individual decisions: The data subject has the right not to be subject to a decision based solely on automated processing of their data, including profiling, that produces legal effects concerning them or negatively affects them.

INDUSTRIAL AND INTELLECTUAL PROPERTY

This website is owned by Hostalric Town Council, who declares that all content created by this entity is licensed under a Creative Commons CC BY-NC-SA licence.

This licence requires that credit must be given to the creator. It is therefore permitted to use and exploit all the content created and prepared by Hostalric Town Council provided that Hostalric Town Council is attributed as the creator of the content, design, logo and any other identifying marks. Commercial use of the same, or of any possible derivative works, is not permitted under any circumstances. Non-commercial use of any derivative works must at all times be permitted for use by other entities or parties with a licence with the same characteristics as detailed above.

Any use without the proper attribution of authorship to Hostalric Town Council with regard to these works will imply a breach of the licence conditions, entitling Hostalric Town Council to request its immediate cessation and elimination, and to exercise the actions it considers appropriate for the license conditions to be respected.

Any intellectual property rights or trademarks owned by third parties are duly indicated and must be respected by everyone who accesses this website. Hostalric Town Council will not be responsible for any improper use on the part of the user in this regard, which will be the user’s sole responsibility, and who shall comply with the rights of ownership or use of the licence stipulated by the third party.

Hostalric Town Council does not transfer ownership of its software to users. The user is the owner of the medium on which the software is recorded. Hostalric Town Council owns all industrial and intellectual property rights, including the software. If the user transfers software from this website to their terminal, they cannot dissect it for study, decompile it, or translate the original object code version or its language into another code or language.

APPLICABLE LAW AND JURISDICTION

These general conditions are governed by Spanish legislation, and the Spanish Courts and Tribunals are competent to hear any issues that may arise from the interpretation, application and compliance with the same. The user, by virtue of accepting the general conditions contained in this legal notice and provided that this submission is possible, expressly waives any jurisdiction that, by application of the current Civil Procedure Law, may correspond to them.
